Access to and use of this website is subject to the following Terms and Conditions, including the choice of law and jurisdiction set out in section 5.  By accessing and browsing the TankBank.com website, you accept without limitation or qualification to the exclusion of any other agreements between you and TankBank with respect to the use of this website.

If you are not prepared to accept these terms and conditions, or if you are not authorised to do so, you should not use the TankBank.com website.  

TankBank may change, alter or withdraw any part of the TankBank site at any time (with or without notice to you) and may also change these Terms and Conditions. These Terms and Conditions were last updated on 1 September 2009 and replace all previous terms and conditions for TankBank.com.

All material available on the TankBank.com website (including content available on our email and storage enquiry services) (the "Content") belongs to TankBank or its licensors. TankBank or its licensors own all intellectual property rights (including copyright and database rights) in the Content and any selection or arrangement of the Content. You may retrieve and display Content on a computer screen, PDA or mobile telephone, print individual pages on paper (but not photocopy them) and store such pages in electronic form on disk or on your mobile telephone (but not on any server or other storage device connected to a network) for your personal, non-commercial use.

You may not use the TankBank site for any purpose not expressly set out above. Without limitation, you may not do (nor permit any third party to do) any of the following without TankBank’s prior written consent:

You acknowledge that “TankBank.com" and “TankBank” are trade marks of Global Storage Agency Limited and that you may not use them without written permission from Global Storage Agency Limited.

If you would like to link to the TankBank.com website, please read and comply with the following guidelines and all applicable laws. A site or service that links to a TankBank.com website:

• may display any TankBank logo  in the same proportion to the text on the site next to which it appears, as is used on this site but must not otherwise use any TankBank trade marks without permission from TankBank;

TankBank expressly reserves the right to require that any link in breach of these Terms and Conditions be removed (and you agree to remove any such link immediately upon request) and to take whatever other action it deems appropriate.

2. Technical Requirements

The TankBank site is best viewed using the internet browsers IE5 or Netscape 6 (or later versions). Any older browser versions may work but users could have limited browsing experience.

3. Limitations of Liability  

The Content is only for your information and use, and is not intended to address your particular requirements. In particular, the Content does not constitute any form of advice, recommendation, representation, endorsement or arrangement by TankBank and is not, intended to be relied upon by users in making (or refraining from making) any specific commercial or other decisions. Neither TankBank, any parent company, subsidiary or associated company of TankBank, nor any other party involved in creating, producing, or delivering this website shall be liable for any direct, incidental, consequential, indirect, or punitive damages or for any loss which is or which represents loss of profit, loss of revenue, loss of goodwill, loss of management time, third party liability, business interruption, loss of use of any tangible or intangible asset including data recorded on any computer or other machine, or loss of any anticipated benefit arising out of your access to, or use of, the website, save in the case of fraudulent misrepresentation, or death or personal injury caused by the negligence of TankBank or its staff.

Without limiting the foregoing, everything on the site is provided without warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability, fitness for particular purpose, or non-infringement.

Some jurisdictions may not allow the exclusion of implied warranties, so some of the above exclusions may not apply to all users of the site or you may have additional rights.

TankBank uses reasonable endeavours to protect the website from viruses but assumes no responsibility, and shall not be liable for, any damage to, or viruses that may infect, your computer equipment or other property, including data, on account of your access to, use of, or browsing in the site or your downloading of any materials, data, text, images, video, or audio from the site. TankBank does not warrant that this site, its servers or any email sent on its behalf are free from viruses or other harmful components. You are recommended to take all appropriate safeguards before downloading information from this site.

Although reasonable endeavours are used to maintain this site, TankBank shall not be liable for any losses caused by failure or stoppage of the site for any reason, including without limitation virus contamination, deliberate damage by hackers, failure of hardware software or systems, power failure, failure of telecommunications lines or any criminal activity of a third party. 

Without limiting the above, TankBank is not liable for matters beyond its reasonable control. TankBank does not control telephones, third party communications networks (including your Internet Service Provider) or the Internet or the acts of third parties.

Notwithstanding anything else contained in the provisions of this Section 3, TankBank’s liability will not be limited in the case of death or personal injury directly caused by TankBank's negligence.

4. Third Party Websites and Services

The TankBank site contains links to other internet websites or online and mobile services provided by independent third parties ("Third Party Sites"), either directly or through frames. Third Party Sites may be co-branded with TankBank and so include TankBank's trademarks. TankBank is not responsible for the availability or content of Third Party Sites and will not be a party to, or in any way responsible for, any transaction concerning goods or services available from such Third Party Sites. If you purchase products or services from a Third Party Site your contract for such products or services will be with the third party and not with TankBank. Our Privacy Policy does not apply to Third Party Sites.

The TankBank site may from time to time contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the TankBank site complies with international and national law. TankBank will not be responsible for any error or inaccuracy in advertising or sponsorship material.

5. Choice of Law and Jurisdiction

These Terms and Conditions shall be governed by, and construed in accordance with, English law.

To the extent possible in the applicable jurisdiction, the parties irrevocably agree that the courts of England shall (subject to the paragraph below) have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these terms and conditions, and for those purposes irrevocably submit all disputes to the jurisdiction of the English courts.

For the exclusive benefit of TankBank and to the extent possible in the applicable jurisdiction, TankBank shall retain the right to bring proceedings as to the substance of the matter in the courts of the country of your residence or, where these Terms and Conditions are entered into in the course of your trade or profession, the country of the place of business in which you agreed to these  or (if different) the country of your principal place of business.

6. General

You may not assign, sub-license or otherwise transfer any of your rights under these terms and conditions.

If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these terms and conditions, which shall remain in full force and effect.

Failure by either party to exercise any right or remedy under these Terms and Conditions does not constitute a waiver of that right or remedy. Headings in these Terms and Conditions are for convenience only and will have no legal meaning or effect.
